    Good post I like it and I probably may follow most of these eventually but, if I think about it, it seems to me lot of stress. Maintaining records from past ten (GC)/fifteen (Citizenship) years is certainly a stressful activity. Except education certificates I never cared for anything in my home country. In spite of taking care of all this, if you get involved in an unfortunate event everything GC/Citizenship goes into vain and back to square one.
    I am not trying to discourage or depress any one. It�s just a thought.
    Appreciate your thought, thanks. Maintaining detailed documentation can be a big pain in you-know-where, particularly if I am asked to do it suddenly today (believe me, I am one of the world's leading disorganized blokes). Instead, if I begin to get organized early, the process eventually becomes incremental and stress-free. That is what I wanted to share here, the idea of getting organized early to have a smoother passage of time later (much like invest-today-afford-later philosophy). Unfortunate events are unpredictable, but that should not mean I ignore what I can control :)

    From what I understand, once the law comes in to affect, labor substitution will no longer be allowed so desi companies can't sell labors anymore. But the 2nd part of the puzzle was that approved labor will only be valid for X number of days (like 45 days as originally proposed) and I am not sure if this impacts the existing labors or not. 45 days expiration may only apply to new labors but no details has emerged yet so we'll have wait and see when the details come out. If it also applies to existing labors then we are home free because after the expiry date, all labors will automatically be canceled. Well, let's wait the for the fine details to come out first.

    As for you, it appears that as long as your substitution is approved before the law comes in to effect, there won't be any problem. If not approved by that date then it's kind of fuzzy as to what will happen. If you haven't filed already, just file premium and I am sure you'll have your 140 approved before the law takes effect.

    I am not using substitution labor. I do not condone any one who does it for monetary reasons.

    So the rule hasn't taken affect yet huh! I will definitely send my application out in premium processing this week. Just worried that I have passed the 45-day time period :( . Does my I-140 have to be approved before this rule is implemented, or just that my application needs to be filed ?

    In a way it's better that there wasn't a huge announcement to solve the visa bulletin fiasco today because we have so many other issues in the employment-based green card process that need to be addressed, that any announcement might have only provided a short-term fix and moved away the focus. I intend to march my heart out and hope that we bring attention to our issues which hopefully shall be put right someday.

    I am desi also, but I hate these consulting companies who do that. I worked my a** off to get a full time job, never faked my resume. People in this forum who blame it on the system are as guilty as the desi companies. Come on people, who are you all kidding, can you commit a crime and balme it on society/system for it? This is the typical of our Indian way of thinking!

    Not so fast...the bill language clearly indicates that the provisions of this bill will take effect from the first fiscal day of the new fiscal year after this bill becomes an act...so unless this bill is voted by the house and senate and then signed by the President before September 30th, we will not be seeing any benefit until the fiscal year starting October 1st, 2009. After the September session, Congress will convene again in November/December timeframe for a short session. If the bill does not get passed then, then come next January, it will be starting the process all over again as it will be a new year for the Congress. Just like green cards, Congress does not carry over bills from one year to the next.

    The effective date could be one of the amendments .... it is changeable.

    I am finding Soft LUDs on all my old h1bs (from first one) over last 10 months. One of them is a hard LUD and it is about the previous employer revoking H1B. But there are Soft LUDs prior and later to that on other H1Bs. All H1Bs are from big / medium corps and no known status issues / violations. They havnt touched the 485s since FP date.

    01/31/2008 (H1B revoke status changed to reopend)
    04/20/2008 (I140)
    04/26/2008 (H1B approved Nov 2003)
    05/18/2008 (H1B April 2005)
    05/31/2008 (H1B June 2005)

    Any one seen this before?..

    Now that they have touched all my H1Bs , I think I will get to find out sooner or later if there they are upto some thing :D

    you can document (some emails/documents indicating that job loss was possible) that you had to move because of things out of your control, i.e. you had intentions of working but because of situation you had to move, then you will be fine.

    same things apply if you are laid off soon after getting GC.
    i learned not to make career decisions based on "potential" future problems.

    Same thing is happening to my wife's RFE response too. We have submitted the response to her RFE (Birth certificate Affidavit) on 04/24. I have received an e-mail on the very same day from USCIS that thay have received the response and the case process resumed. I saw soft LUD's on 04/27, 04/28. I guess it will stop after couple of more soft LUD's as our PD's are not current. I assume we are okay as long as we do not get more RFE's on the same issue.:)

    I am afraid you are being naive here. What the OP is saying is

    (1) We should all go back to our home land, because he has some opinions and positions on what is considered turning back to home land. You might not see it but he is trying to shape opinion of others very intelligently. Who says this? Some one who does not want competition here. Well, if this was coming from some one who is in India I will give him props. He is in US for 10 years and he is saying US GC system sucks and I will go to canada in 2 years. Damn it! I am better than him because I will go to India and not canada. I will stop short of saying that every one should go back to India or his/her homeland.

    (2) We all have no right to talk because this is not our country. or We are not in our country and we should not talk. Who says this? Again folks who dont want people here.

    (3) Even if I give him the benefit of doubt on other issues, he thinks country caps are OK. Any one who argues for country caps in EB GC with out asking for a country caps in F1/H1B which server as conduit to H1B actually wants the disadvantage to lot of people to his advantage.

    Just dont read the words as it is. try to infer some thing. These days trolls have got too much brains.

    I agree with you on some aspects , I just didn't like the way ganguteli got flared up.
    I believe , nitin has the right to voice his opinion (many people would agree with him, many would disagree). But there is no need to fight like illiterate people. If someone doesn't agree , he should say i don't agree, and this is what i believe in.

    I like US very much , i am here for around 5 years , and i believe the GC system really sucks (don't you ?)But i have some commitments in India , and if i don't get a GC in 1-2 years i will go back. All my college batch mates in India are managers now , and i am still a developer. I cant take a better job , because i don't have a GC, and with EB3 India, by the time i will get a GC, i would be about to retire :-)

    So everyone would have a different perspective, and different opinions.

    I do not appreciate you pretending to know what I think of everyone in here and their work. (Which just for the record I appreciate very much!)
    Simply put: I did not and do not think of anyone in here as an idiot.

    So please refrain from saying that in future.





    However, if all you think of IV is as a message board and a bunch of idiots trying to fix things that may never get fixed, and if they do - you'll always stand to gain - a membership-based organization would better serve the needs of the rest, imho.

    Many in IV will know that I have never opposed legal porting. However, I disagree that this is a way to get out of the mess. There is a fixed total number of Visa available. Per current rule this first comes to EB2 and is consumed completely leaving nothing for EB 3. If all (or majority) EB 3 moves to EB 2, the chocking will be in EB2 . So the "mess" just shifts its position.

    The true way is -- 1) Recapture, 2) Exclude dependents from Visa Number

    As I see it, the only persons benefited are the ones having the priority dates in ancient times. I think we really should not mind letting them have their GC's, being our seniors.
    Yes, later year porters might end up having to wait. It's all in the game, fortunately or unfortunately. One thing is for sure, we as a whole, have an uphill battle
    If it really comes to matter, I think it should be easy for an EB2 to port to EB3 if the dates are current for him in the different category. So if I were EB2 today, I wouldn't be so apprehensive :)
