Last year the H1B US MS cap wasn't over until the mid week of April and I think this year it's not going to be the same as there were a lot of missed MS applicants(I am one of them) but I don't think that the MS quota cap has no reached yet.

I am not the prototypical IV member in that I have only been on the H1-B visa since 6 months after graduating with my masters .. my company hasn't even started the GC process yet. So my interest in legal immigration reform is more from the perspective of someone who will enter the GC pipeline in the near future rather than one currently stuck in the BEC/retro mess.
I began working for my current company (a high-tech start-up) as an intern when I was still a student .. my work on a prototype VoIP solution for cellphones helped the company win a second round of venture funding .. and needless to say, created lots of jobs through company expansion. I am currently very well placed in my company and seem set for a good future with them.
However, seeing the plight of other, more senior talented EB folks here stuck in limbo, i am seriously re-considering my options .. I think its better to switch to a plan B now, rather than invest several years of time and emotional effort in my career here only for me to be stuck in legal and professional limbo. I have already applied for canadian permanent residency, and if the status quo continues, I will have little hesitation in moving there, to a company in my area of expertise. I assure you that several of my classmates are in the same boat as me. If the GC system is not fixed anytime soon, I am fairly sure the retro issue will disappear by itself in few years time .. coz there will be no more applicants left to be enticed by this american mirage.

On the same note I have a question for the Gurus.
My name is reversed ( first name and last name interchanged) on my SSN and hence on my credit cards, employment letters etc though my name is correct on my passport , H1 , I-797 and on files AOS.. etc.
Will this pose a problem in the name check process?
My attorney said I should change my name with SSN after EAD/AP arrives.
Let me know ur opinions.

And all of us who are from India, let us not forget that INDIA faces similar issues of cross-border infiltration ( the reasons may be different), form some of our less than friendly neighboring countries.
Indian forces are trained and instructed to foil these guys from crossing over by whatever means necessary, including blowing their heads off with a well placed gunshot...and if arrested, we all know how our Police forces and other investigative agencies treat and interrogate the people in their custody...
Just one hypothetical question for these people...What if a pregnant female terrorist is arrested by police in India, just before she was about to engage in some terrorist act in India itself, is arrested and is shackled to her hospital bed, while she gives birth...would all of these "human rights supporters be saying these same things...
Where does the "humanity" that these "holier-than-thou" people are talking about, go.
We all feel happy when intruders are shot or arrested at out land borders....
If India has the right to protect its territory from illegal incursions by Citizens of other countries, why not US?

Take it easy... This is just for humour, to have fun at these times.
No green card for you. Just work well for 6 years, enjoy life in US, enjoy sports cars by renting, not by buying, rent a big house, have a lawn and garden in back yard, grow your own vegetables. Have nice vacations like Hawaii, Jamaican islands, Vegas, Porto Rico etc.,Have fun in life. Do not go for green card. After 6 years, get nice job in India,own apartment near to office and ask your parents to live with you. Take kids to school . Have fun with them. Try to become director, AVP,VP,SVP,CEO,CTO and President. Do not go for green card. After you become director, buy a single family home and mercedez or BMW and have fun. Here is something i found on the web for the interpretation of labor sub cases, the original PD stays with original beneficiary, but when the labor certification is used for another beneficiary then USCIS should allocate the new I-140 filing date as PD, not the original LC date.
Following link suggest that labor substitution should not grant PDs.

Thanks a lot to all members for being with us in this struggle. We have tasted our first big success this year. Credit goes to each and every IV member. We were all affected by the visa bulletin fiasco and this is our victory. This is a victory for all our members and we must rejoice.
IV had worked very hard and had been pushing for this in the background. Our flower campaign, rally and other advocacy efforts all came together and helped us at a crunch time. We thank members that sent flowers and also walked in the San Jose heat for 4 hours. All that really shows our commitment to this cause.
We are happy that our efforts are successful and IV has been able to make a difference. Please also know that during this effort, IV was extremely active and decision makers heard our voice. We cannot give out all the details but what IV members should know is that these efforts should make each one of us proud and what we can do if we have a firm resolve. We were also the first to break this news even before anyone else or media could, and continued to update our members as time passed.
IV also thanks its contributing members and it is because of their contributions we were able to continue this effort. Many thanks to the members that are contributing now after this good news.

Its high time since we spent in doing the guesswork. But sadly that's the only way to get out of the mental agony any one in EB3 stands as of now.
Even obama has indicated that immig reform is in the attic and also visa bulletin site shows wordings like that 10000 numbers for EB3 has been cut to 5000 (it must be saying from long time back itself) which is another pain in the already open wound of EB3.
Good at least EB2 moved but sad story continues for EB3. My guesswork is that for EB3 some daylight will be possible only around feb 2010. If no moves happen even in next year then its s%^t for all of us in EB3.

Granted you scored a point when you were allowed to file for employment authorization this July. If your one rally worked, do you really think other rallies will work too? The world of politics is driven by numbers; you do not have enough numbers to get any lawmaker interested. So wake up Macacas, admit it, you all are bunch of losers.
So far as the skills are concerned, you have been harping on the theme that you are highly skilled? If the definition of highly skilled is a mere undergrad degrees then 75% of Adult Americans are highly skilled. I bet not even 5% of you have PHDs and you call yourself highly skilled. Huhhh
And this for the leadership of your organization: You are wasting your time. If you are so desperate to get green cards contact me. We will see what we can do… One thing I believe though is this country needs people with leadership skills and not so called "Highly Skilled". So I will be more than happy to work with you.
