    It is good idea. And ofcourse better than visa number, EB1/EB2/EB3 and all other crap. Countries like UK, Canada, etc. have similar kind of immigration policies.

    Even after having such a relaxed immigration rules, only leftovers go to Canada, UK and Australia.

    All these happend to me on NWA and Lufthansa as well. It is just that day and time.

    I have worst experience flying Gulf Air. I have never again used that airline. They treat you like bad and only way to get your rights is to fight and create a scene which I cannot do so best option is to avoid that airline.

    I had recent experience with continental the flight got cancelled but the staff was good they immediately gave me tickets to Virgin Atlantic (which was earliest departure) but I had Advanced Parole and so could not take VA. Then I asked if I can get Qatar Airways and they did not ask any questions immediately booked me qatar. So my experience with continental at ticketing desk was awesome but the staff inside was not that great they were just Ok.

    I feel Qatar is the best airline to fly. I prefer that one for now.

    By pure luck and fluke, I was able to get an Infopass appt for Sep 11

    There was only one appt available for the entire month of sep 08 at Tampa office.

    Hopefully I will know something concrete on EB-2 visa drainage system.LOL :)

    No need to shout here...I know this is an educated community and I am trying to hold a logical debate. But very few posts have any logical responses. So far no convincing argument has been put forward explaining why they deserve the coveted work permits (aka Green Cards). This shows the immigration system need to be fixed to filter out such nuances.

    To support my point, please see my additional posts: 101, 105,110 and 117. All responses I got were just BS, with no logic. These people know only how to talk with no action. America is a country of actions with razor sharp focus.

    So my friend ,a personal advice to you: I have been following yours and others posts closely. You are wasting your time arranging all those buses and all other BS. The rally will not succeed. Just take a look how many people you have so far? Admit it you just don’t have the numbers to succeed.

    Moderators/IV leadership please note that I would want to complete my series of replies and there are 10 more replies remaining. I feel that those posts are worth being replied to. I will appreciate if you will let me put my points. Thereafter, I really don't care.     yes, we are definitely expecting a response and thats why we are stating the timeline.
    At minimum, we definitely need to higlight with details as to how USCIS is playing with us.
    Nobody can predict whether we will get a response or not. But, we definitely need to satisfy ourselves that we fought till the last.
    2 or 3 years back, nobody expected IV to achieve anything. Look what IV has achieved today. It only happened through relentless protests.
    During July fiasco, everybody was resigned to getting their 485 files returned back. The force of IV protest made the reversal.

    I am confident that with lots of protests, USCIS will churn out a few approvals in the last week of September. At least, guys who got RFE can expect something. I am not one of them, though, as my file has not been picked up at all. that is a different issue.

    Well, There are many people still waiting for GC with original labor and not substitute labor with PD 2003 or prior to that. I'm not saying Sub Labor is the only reason, but it is one of the reason. Even though they are few...the impact is big... With 7% per country limit and visa numbers looks like would not spill over to EB3 due to demand in EB2 and other categories, even very few (say 3000 - 6000 labor sub applications) could consume a year or 2 years worth of visa numbers for this category for retro countries.... Even each family member (dependent) would consume a visa... with atleat 2 visa per applicant, 3000 - 5000 total EB3 labor sub could easily consume 2 years quote... if you count all.. then the "U" in VB might make sense... For EB3 ROW, there are lotz of people from Canada, S. Korea, Thailand, Australia, UK etc, and it went 'U' from 2003... The dates could move well for ROW... but for retrogressed country, I do not see the bright side yet.... Also the 485 PD was current for all categories almost all of 2003 & 2004 till Dec 31 2004, It retrogressed starting from Jan 2005 and later.... Also, the total 140,000 is for all EB categories. The 3000 - 5000 is just a conservative realistic guess.. not based on any data. Do the Math !!! You might agree !!!

    Even if you assume there are 3000-5000 labor subs that chocks up the queue, it might have benefited the ones with a 2003 PD like yourself. But for others (beyond 2003) , it is not much of a help. A visa recapture would benefit the community at large.

    Even if you consider 3000-5000 labor subs, not many of those are "sold" labors, many of them are legal ones. labor subs were all legal until some companies started selling those.

    Mine was filed in TSC and it moved to CA and then moved back to TSC. The place originally filed will be considered.

    Once again those who have already received RFEs know for sure that their files have been touched and many of these are outside the RD or ND of the I-485 filing.

    So USCIS is like a fish market and no logic whatsoever be applied...we can all reason but it is futile...just like the stock market which can go in any direction so is output from USCIS.

    Correct me please if I am wrong.

    When taking an Infopass appointment, is it ok to choose the option of
    Step 1. Case pending
    Step 2. If it has been over 45 days since you contacted NCSC and have not received a response to your inquiry. You must bring the Service Request ID Number related to your inquiry to the appointment

    Did anyone use this, even if there was no Service Request filed? Were you asked for a Service Request number? If not, what option does one use to take an appointment?

    As per this $20 drive, I tried to contribute thru my Visa Card & it was "repeatedly" prompting card# enter is invalid...I checked/ensured expire date/secure code & info which I entered is correct but repeatedlly it was prompting same message...Anybody from IV can help whats wrong with the web page?

    I tried to submit request my request 3 times, does it mean that I have contributed 3 times?

    I really don't understand why people think I am lying????
    When I read the memo, I was more worried about my name check and whether she would check the status of it than about this, as anyhow my dates are not current. After showing the memo, she did offer to check the status.

    With all the experience our guys have with USCIS officers and staff, it's hard to belive an IO would be that helpful? But, she's and even the staff at this office is not as bad as others have experienced.

    I was even telling my wife about the behaviour and how staff at other offices behave.

    Yes, it is indeed a stressful time. If your receive date by the center where your case is processed (which may be different than what is printed RD for July07 filers) before Aug 30'07 for TSC, and Sep15'07 for NSC, you can definitely expect your case to be preadjudicated and waiting for visa in sequence of your PD. This should translate soon into a good news for you. However, it does not mean that everybody else whose PD will be current in Sept will be left high and dry. A lot of cases (but not all) beyond the published dates may also be waiting in the preadjudicated que. Note that published dates are of June 30. Once preadjudicated cases are exhausted, "random" pattern seen last year might begin as then there is nothing waiting in sequence of PD.

    I will give you a couple of reasons, why I am not supporting this idea, at the same time I won't discourage you from doing it:

    Last year when CIR was being discussed in Senate, anti-immigrants sent thousands of bricks to Senator's offices. Bricks build walls, their message was clear, focus on border security first. This was a -ve campaign. It was popular in the right wing media but since CIR passed in Senate. I am presuming this campaign didn't work. The reason it failed was because the idea was to grab headlines but no thought on what after that. No strategy. Lets correlate this with flowers. An officer at USCIS will get these or maybe a dozen people. They will feel good. End of story. They don't have the ability to change the USCIS policy or the July bulletin, which is IV's aim. So basically sending flower is a gushy gesture and may sound fancy but USCIS doesn't work on emotion. If it did, why would they loose thousands of visas each year even though there is rampant backlog and retrogression?

    Some members say well, flowers will attract media attention and hence help our cause. Well, unless Paris Hilton is sending those flowers you won't get much media's attention. Indirect, subtle and passive communication doesn't work in America. That is a cultural issue that these members need to come to grips with fast.

    Our goal is to make USCIS accept July applications for AOS for GC. Since USCIS won't do that whats the best way to do it, well to exert external pressure. How is that done. Contact Media, Senators, Congress members and the Judicial system.

    Too much babbling on my part, now, I am going to write a journalist requesting more media coverage on our issue.

    We are not sending pen, paper and cal to caluclate the accurate VB. And one more thing we are not fighting for it, just we are telling how badly we effected with the "flip flop" game of USCIS.

    Pls see the first page for plan of action..we are gonna send the e-mails to reporters...i guess this is gonna big hit.

    When you are writing to journalist mention about the JULY 10TH FLOWER DAY!! I am sure she/he will ask couple of questions abt it.

    I am new to this forum, so I am joining this tread.

    Hello,
    I worked up nerves to consult with the forum.
    Please read my history and answer questions below.
    Your non-judgmental and objective answers are greatly appreciated.

    I first came to the US on a tourist visa when I was 15 years old.
    I was out of status when my parents couldn't act fast enough to change my status. However, I faithfully maintained my status once I reentered with a student visa.

    So here is the history:
    Dec. 1986: Enter the US on a tourist visa (age 15)

    June 1987: Out of status from the tourist visa for 10 years

    Sept. 1996: IIRIRA 96 passes-- 3yr./10yr. reentry bars apply effective April 1, 1997

    July 1997: Obtain I-20 for school, leave the US and return to home country (age 26)

    Aug. 1997: Reenter US on a F-1 visa

    Oct. 00: Initial H-1B

    Oct. 03: H-1B extension

    Dec.04: RIR filed (priority date)

    Sept.06: RIR approved

    Oct. 06: H-1B (7th year) extension

    Jan. 07: I-140 filed (pending approval)

    July 21, 2007: Preparing to file I-485 with the same employer since 2000


    So here are my questions:
    Q1. The way I interpret the law is that the 3yr./10yr. reentry bars apply when the law went into effect starting April 1997. Is that correct?

    Q2. If so, would I have to worry about getting the I-485 approved?

    Q3. If not, should I filed for I-485 at all?

    Q4. Any suggestions or possiblities to consider?

    I found the Eligibility requirements for I-485 AOS in the Code of Federal Regulations here:

    You will find the eligibility list at 8 CFR Part 245, Section 1. Most of the eligibility requirements are based on the validity of your status since your last entry. There is a clause in there (8 CFR 245.1 (b)(10)) that seems a bit draconic but it seems to apply only to people who were working. I did not find clauses that search that far back into your status history but you might want to take a look yourself.
