the point is well taken. but the categories and priorities were created to be based on the jobs too.
and there are people in EB3 with bachelors degrees only. so what? it's meant for jobs that need a bachelors degree. it is indeed your misfortune to be in EB3. and we all know that its a problem and that is why we are fighting for reform. however, the comments made by ns33 were inappropriate and needlessly divisive.
look, i am not trying to pull down EB3 folks in any way form or manner. my comments were exclusively meant to explain the need for categories to my friend who has been whining on this thread about iv being about EB2 and the need to give EB3 Gc numbers AHEAD of EB2. that is hardly a solution.
now, for the last time, if this does not stop, i will indeed close this thraed.

Eb1->Eb2->Eb3 is correct only from education and experience for the Job point of view but not true from Quota point of view all get 33.33per year.
�The argument that Eb1 is preferred/priority above Eb2 and BE2 is preferred/priority over EB3 is absurd.
The regular yearly BE quota is distributed equally among all three categories that means equal priority for all groups. So then why they should not follow the same distribution for the overflow numbers also?
Said that all BE3 applicants who are eligible should port there PD to EB2, simple. When you know how the system works try to adapt to it.�
We filed our CGs when we don�t know the system, we just trusted out attorneys. If we have to do this CG stuff again most of us will do it differently.

Hi all:
Thanks for all your advice and understanding. I could not post earlier as we were busy following up the case with the authorities. I have two lawyers on board and a wonderful, unexpected, child abuse NGO person helping us deal with the situation. Most importantly, the baby is in perfect condition after having everything scanned and reviewed with two pediatricians�.it is possible, as one person helping us mentioned that the rough handling may appear exaggerated on the video bcos low resolution cameras sometimes exaggerate slower movements into sudden and forceful movements (I don�t fully understand)- which is also ok w/ me as my child having been safe is more imp to me....at the minimum she will be deported and barred from entry, or likely fully convicted and behind bars...from what I have heard till now, we will likely not be penalized as there are some protection and immunities in these cases for those who testify (and most certainly INS will never be involved)�and at most there may be some fines�
....and to some others who have misread a few things I mentioned: a/ the baby did not remain with the nanny for even a second after we suspected something fishy b/ we were not saving money with this nanny: 350$ (plus food, commute, and phone cards is above average here even for a legal worker. Also we selected her after observing her (and earlier another nanny) at home for 2 weeks with the baby while my mom-in-law was there and all of us had felt for some reason that she was the better one��..and to everybody with kids: no matter how much you trust your nanny, however well referenced they are- use a nannycam�.you may amazed at what you see�.there is something about having the whole house to yourself with an infant that makes some people crazy- so that their suppressed anger/envy and whatever else is hidden comes out on a poor speechless baby.

I was just thinking and then this came up on me . How about sending a poster along with the letter campaign. I can contribute atleast three posters. They do not have to be full size posters ..can be just A4 size pamphlets kinds. We can just print them in color printer and send them along with the letters. These posters may make it to the press also as they will be funny and spicy for news. Actually, we can send copy of our letters to press as well along with our posters. If we make about 10 such posters, we can send one random poster along with the letter.

Since the dates went back ppl wake up and say now I want to shoot this bird, not knowingly how many cases are there... A simple question to you, (I know the point this thread is raising is going no where becoz for years many ppl discussed this and at the last USCIS deciced to stop this forever which is indeed a good move).
Will all the ppl who came after ppl stuck in BEC (Labor) will go back the line ? will they relinquish ... A simple answer "NO" So why are we debating on items that doesnt exist?
IV for now has only one goal "recapture". There is no way USCIS can go back and change the dates who ever used Subs( I am not talking about FRAUD- FRAUD shouldnt exist period) as per law the dates should be ported.
The intent of a subst labor was to save the company time and money for obtaining another labor for the same position in case the original beneficiary drops out. Remember, labor was a company petition, not employee petition. The companies still would have wanted it even if it does not retain its original PD.
The basic thrust behind the idea of changing the rules of PD allocation for subst cases is to push forward PD to july 07 level. Most of the subst happened in that month. we are not asking subst labor folks to quit the queue, just asking them to move behind.

Now every member that had a negative comment towards IV today after noon should be ashamed. There were some harsh criticisms. BTW if anyone is interested, child birth generates 9 dols (measure of pain) of pain and at 10 dols a person dies. 9 dols is maximum pain a human being can suffer.

The sheriffs dept took her to the hospital to ensure that in case there is any complication, things could be take care of. Why? Because its the law and the majority in this country respect the law. No one, even illegals, can be denied emergent care. This would not happen if she were in Mexico or India. No free medical care there, and no one gives a shit about the rights of prisoners there. So what happens next? This woman, WHO HAS NO BUSINESS BEING IN THIS COUNTRY, goes to her advocacy group who arrange to have an article in the news that tries to portray this as if the sheriff forced her to deliver in a prison. This is all to garner sympathy for the illegal immigrant. We should know better and see through their guile. The illegal lobby is the main reason why there is no chance for meaningful reform for legal immigrants to be passed. They insist on linking us to them.
If every one decides to choose for themselves which law they will obey and which they will ignore, society can not exist. And as I pointed out in my previous post, this woman has a history of repeated violations of the law and is NOT a victim that this biased article tries to portray her as.

Pain is a subjective phenomenon and what is expireinced as a 9/10 by some hysterical yuppy, will be a 0 to others. Childbirth is a NATURAL phenomenon. I believe my case is pre-adjudicated.
My lawyer says she has a way to contact TCS but not to NSC.
Is there any way remind NSC about my case becoming current in september 2009?
If your "real" receive date (what you see online as "your case was received on...") is within the published processing dates for your service center, and your case is straight forward, most likely it is preadjudicated. In that case, as their SOP says, they put them in PD order in waiting for the visa. See the SOP below (which is a bit out of date). You are pretty high in PD seniority. you should get a good news soon. Best of luck.

Based on multiple PM to me on this issue:
