I'm in the US on a H1B visa since Oct, 2003. My current approval notice
(I 797) has an expiry date of April, 2008. However I do not have a stamp on my passport reflecting the expiry on April, 2008. The only H1B stamp on my passport was that obtained just before my first entry to the U.S on a H1B and the expiry date shows June,2005. I didn't have to leave the country since my entry date and hence didn't find the need to get the visa (current approval) stamped on my passport.
Since one can apply for a H1B extension 6 months before the actual expiry date which will be November 2007 in my case and if I do so and obtain a new approval notice (with an extension of upto 3 years as I have a I 140 approved with my current employer) and if that notice has an expiry of April 2011, then if I go to the Canadian US embassy in Jan, 2008 to get my H1B stamping done in the month of January, 2008, will the new stamp have an expiry date of April, 2008 (current approval notice) or can I get a stamp valid until April, 2011 (based on latest approval notice)?
Your help is highly appreciated.

You seem to be a Junior member so I would like to tell you that if you have query that is not relevant to the one already open , you start a new Thread. You do not post your query to an existing thread and piggyback on it.
You can go to FORUM and click on NEW THREAD and enter an appropriate title and then enter your query.

To put it in other words...lets say u r very hungry and go in a restaurant....Just bcoz you r very hungry you don't start to eat from somebody else's plate....you would take ur own seat SEPARATELY and order your own food.....Think of posting query's in the forumn similar to that....And that goes for everyone else hijacking somebody else's threads..
Don't mean to be RUDE ..but I am getting sick of people hijacking threads and deviating from the original query...

Hi Apple,
I am sorry to hear about your case. Do not loose hope. I think it is a very common case in USA. You have achieved so may things in your life so far. You will not loose all of your hard earned money for such a normal case. I think, you should not hire a lawyer until you need to support yourself. Let the insurance company lawyer handle the case. Try to get all the information possible from company lawyer. And contact few lawyers personally & get advice. Keep the information, but do not hire. Hire a lawyer, when the company can not continue their lawyer any more.

Yesterday, I was a citizen of X - country , I support X whole heartedly, today, I am a citizen of Z - country, so I will support Z whole heartedly - more so because the whole naturalization process is not an OFF/ON switch either.

Less than 800 contributions is such a shame.Assuming all the 3000 are affected by the retrogression it just doesnt make sense not to donate anything at all by the remainder of the members. People will have to understand how much of a difference it would make if everyone contributes.
Looks like the donors who have already donated have to donate all over again and that in double to make up for the deficit and to reach 150k

A short digression to an answer.
Most CS undergraduate curriculums have a 4 course sequence CS-1, CS-2, CS-3 and CS-4. This means that CS-3 is pre-requisite for CS-4, .... In CS-4 it is not possible to answer CS-1 questions. The instructor gets irritated if you do that.
Your following concerns are covered in Retrogression 101.
1. Things change in DC. Core had some info in Dec/Jan that changed.
2. No one can promise anything. Bush is the most ardent supporter of CIR but can (will) not get it done.
Nothing happening as some core members wrote in very optimistic tone about Feb 15. No congressman is even talking about it lately.
Are core members trying to just enroll more by giving hollow promises?
It is very irritating for someone in Retrogression 401 to answer Retrogression 101 questions at the rate of 1 per day with no desire to be educated.
I have tried to answer a Retrogression 101 question in Issues surrounding Immigration Voice's disclosure of Funds (http://immigrationvoice.org/forum/showthread.php?t=3236&page=5). My answer was from a URL without my opinions. This thread was devoted to this one person. The answers had no effect on the person. We wasted a day on it.

This can financially drain you out. My insurance agent told me that they cant get the money straight out of your bank account , because how will they find out your bank account number and the bank? How do they know how many bank accounts you have? What if you send money to India before the judgement is entered against you? If you have a house, they can go after your house or car. What about their own insurance policy? Maybe their insurance can also pay as uninsured motorist pay? Retirement income is usually protected in some states and hence I dont think your 401K is at risk. Once your insurance company pays out the maximum, you can basically say hands up, I have given up.

desi companies r indian companies and they sell LC openly , Eb2 pre approved labor has a rate approx 20k USD .
desi companies sell H1b also , u pay money and they will get it for u , see sulekha.com for example .
I am not in the IT industry so I have no idea about these Desi companies till today. If they sell EB2 LC for 20k USD, how come there are still so many people waiting instead of buying a GC?

Finally I am a US citizen after being 10+ years in this country. This is one of my biggest fulfillments and it means everything to me. US is just not home anymore for me, it is my country.

nope, if the alternative to the GC system is outsourcing (as you yourself mentioned) all the profits go to big corporations and our salaries are spent in India. The corporations are notorious for avoiding taxes so teh government gets nothing. By making us stay here longer (on H1 or GC) we end up spending our salaries here, paying taxes, paying social security, paying medicare.
65K H1-Bs earning 70k a year is 4.5 billion dollars. 140K new GC holders each year earning the same comes out to 10 billion dollars. Out of that taxes alone are an easy couple of billion or more dollars. Then take into account the side-effect (we buy cars, we buy appliances, we rent apartments) and the contributions we make to this economy are a lot.
And to say that we are stealing jobs is also inaccurate. There is nothing called stealing-a-job. In general every job is worth how much someone is willing to be paid to do it. If an American citizen wants 100K and the GC holder wants 90K and the H1-B visa guy wants 80K (and all of them are going to work in the same city and same office) the job is worth 80K. The H1-B visa holder is not stealing a job. The days of knowing HTML tags and commanding a salary of 100K a year (1999-2000) are long gone and now replaced by 'that kind of work gets done in India or Ukraine for 10k a year'. Looking at the resumes we got in response to job ads placed in the last 3 companies I worked for, there are simply not enough qualified americans interested. Thats a fact. So the IT sector needs help from abroad to get the job done. They can either send the work over, or bring the people here. Bringing the people here also benefits the rest of the economy.
I did not say outsourcing is the only alternative. I said they will have their own people take these jobs or if not, they will ship out these jobs. Do we really believe there aren't enough Americans to handle IT work in America?
H-1b is not cheap labor. American companies prefer to hire H-1bs with US master's degrees or with substantial amounts of US experience. When they do hire foreigners, they do not discriminate against them by paying them lesser.
H-1bs are abused by desi vendors and the like who take advantage of the indenturing nature of the visa and also on the naivety of "fresh off the boat" people who newly arrive into the US and are unfamilar with US economy. They are starry eyed, still busy converting each dollar into their local currency and feeling happy they are earning relatively more and dreaming about paying off their EMIs back home, sooner. It takes quite a few months for them to settle down and understand US dynamics.
Lastly, we should not confuse the need for H-1bs as equal to the need for GC holders. Take the example of middle eastern countries. They use foreign labor, but they never grant them permanent status. That way, they do not get stuck with them in the event of a downturn. American could have chosen to follow a similar model. Use H-1b temps when necessary and send them out when they are expendable. They have no reaons to hand out GCs, like I said earlier. The benefit is all ours.

All the wasted numbers can be recaptured when recapture bill passes!!!!
I believe it will be the same old story. They will wait till last quarter and then will waste thousands of visa numbers because of their darn slow processing hands and we people will again start talking optimism from Oct 2010.

In same vein, driving on road is privillege not a right.
With 'privillege' you have to follow existing rules religiously then if it was a 'right'.
In anycase, what we can only do with existing law is work with law makers and not protest.
