Just a friendly thought from a co-member, If you are motivated to attend the advocacy event, why dont you consider sponsoring your travel? We should try to keep the donated miles/hotel points for on-the-edge members who we will have to try convince at the last moment when we closer to April.

Keep in mind two things. Many, quite possibly most of the July VB fiasco filed 485s have not been processed yet, Eb2 or EB3 India. There have been more recently (in the past couple of months) but still not most. A good number of those filers had earlier PDs.

The democrats will take the house by a very large majority and the senate by a less-than-60 vote majority. So if CIR makes a come back republicans will not be in a very strong position to strike a deal on high-skilled immigration. But there are a number of democrats who also support high-skilled immigration. People opposed to H1B and employment-based green card reforms are on both sides of the aisle (Dems Dick Durbin and Byron Dorgan, Republicans Jeff Sessions and Chuck Grassley for example) but hopefully they will remain a minority. It also looks like vocal supporters like Jon Cornyn will win re-election. But Pete Domenici is retiring. So, on the balance, there will be some change but not a drastic change on the legislative side.
Sen Obama is a very pragmatic and thoughtful person. I dont really care about the website outages. Thats not the main issue. Two or three core/senior volunteers are always running a contribution drive. Imagine thse people doing some thing more productive than running funding/media drives. When shyt hits the roof, we have a boat load of people asking when the hell shyt is gonna be all over us or how to wipe off the shyt. IV's strength lies in its members and all the time IV members have not responded to enroll in a monthly payment. People want GC's, but they dont want to pay for the fight. People want GC's but they want accountability for 20USD. People have point specific issues about themselves and their imigration issues and are happy to leverage the knowledge of the IV community, but do not care a damn about IV community. Those who pay, pay twice, pay thrice and even more. Why should any one do it? Why should others just simply browse and get answers for persoanl point specific issues? Because of that they tend to become hyper sensitive when it comes to immigration matters, especially when they think someone is stepping out of line and trying to manipulate the system. Dont mean to imply at all , thats what you are doing.
Your case is too complicated and I haven't come across such a scenario; I'd suggest talking to an attorney; while it might be expensive, some attorneys might be willing to talk to you free for a few minutes, for a basic consultation. Atleast you may find out if you are legal or not.

Now for the rest of this year the EB2 queues for China and India are merged. Visa allocations will be solely based on Priority date. So for example if India has many priority dates that are before China's, India may end up getting more visa allocations. The same holds true if China has earlier priority dates than India does. That's how I inderstood it and I thought I would try to explain it to some who did not. Otherwise sorry for stating the obvious.

(1) Go to their offices and meet their legislative assistant/ aide's
(2) Call them.
If you haven't called Rep Smith's office, call now. If you did encourage your friends from San Antonio / Austin area to do so.

The section is 8 USC � 1255 (k). Also known as 245(k).
Here is how to find the text of 245(k) on USCIS website:
1. Go to USCIS.gov
2. Go to "Laws and Regulations" menu item on top menu.
3. Click on "Immigration and Nationality Act" on the left menu.
4. Click on the link that says "Immigration and Nationality Act" below the 2 paragraph lecture.

There are many guys who always post constructive threads all the time. I may be one of them, if you look at all my previous posts. I can help in cleansing some bad threads here. This thread is insulting to us all, and more to you who maintain this forum, if I am not wrong.

If your transit time is less then 6 hours and you hold a valid US VISA or Green card, you do not require a transit VISA.
* No airport transit VISA is required, if your tranit time is less than 6 hours and you are holder of USA Permanent Resident Card (Green Card) or a valid permanent resident permit in any of the countries of the European Union or a residence permit in Iceland, Liechtenstein, Norway, Switzerland, Monaco, Andorra, the Holy See, San-Marino, Canada or Japan. (if your layover is more than 6 hours, you need a transit VISA even if you have the permanent residence permit for any of the countries mentioned above).
* No Airport Transit Visa is required if your transit time is less than 6 hours and you hold a valid USA visa in the passport and confirmed airline tickets (no open tickets) for these nationalities only (if your layover is more than 6 hours you need a transit VISA even if you have valid US VISA).

If you hold
a residence title of a member state of the European Union or a member state of the European Economic Area (EEA, i.e. Iceland, Liechtenstein and Norway) or
a residence permit of Andorra, Japan, Canada, Monaco, San Marino, Switzerland or the USA you do not need a transit visa.
Airport transit travelers who are holding a valid visa for the USA (an approval notice is not sufficient), Canada or Switzerland, are not obliged to obtain an airport transit visa prior to departure. Until further notice for these travelers a "visa on arrival" will be issued by the competent authorities at the respective airport in Germany and no specific action is required from them to obtain an airport transit visa.
If you are still in doubt whether you need an airport transit visa, do not hesitate to call the German mission which serves your place of residence in the US.
