Just a quick clarification. The time line extension for Admin fix letter campaigned was requested by various state chapter volunteers including myself, abhijit and others. The reason was the traction they were gaining after volunteering on the ground for few weeks. The idea was to leverage that instead of just ending the admin fix letter campaign on a fixed date.
I agree with the reasons behind it, now that I know it.
Just so, everyone understand, I am not trying to find fault with IV or its members. I am trying to do, what you can call, soul searching.
We have around 25000 members. Why only 25000, when we know there are millions out there in the same boat. What is stopping them from joining IV and contributing? Of all these 25000 or so members, we only have around 4000 letters sent for Admin fixes.(May be I am wrong about this number, but I believe it is around that range.) What is preventing the others from doing so?
I strongly believe, that the answers to these questions might help IV in the long run, with more members and possibly more active members. Once we get to that point, IV will no longer be an organization, but it will be a MOVEMENT. Chances of success for a movement is always better than that of an organization. That is what I believe we should try to achieve. I hope everyone agress with that.

If your attitude is "I will get on IV JUST because I WANT something" and "If I got it, I don't care" and "If I have questions during naturalization stage, I will get back on IV" may not mean that you have a great life or enjoy life after GC. Life after GC is not that rosy as you think. Big companies - hiring is the same for GC/h1b so u will not have preference. If you are independent and want to do something on ur own - it is not easy either - it is more stressful and challenging - this is life my friend, 95% of startups fail and these people are seen nowhere after that. Very few people are successful and that too with a lot of difficulties, hard work and faith. The "enjoy life" after GC is generally not U but your next generation (children) will bear the fruits. they will enjoy all the freedom and comforts until reality hits them in form of career and family life - this is something everyone faces.
A lot of people love to be on IV - say, if someone has answered someone's question on IV and the person is benefitted - thie person is extremely happy for the other person.
A lot of people who are active actually love and are passionate about what they are doing. Lot of people want to do their 2 cents or more - this is what this organization is all about.

it is pure exploitation of physicians on j1/h1 visas. And everyone know about it, including the law makers.
People finishing residencies and fellowships on j1 visa go through some unscroplous lawyers and agencies and manage to get a waiver job by spending at least 20 to 25K.
What I want to say is, entire system is like this. Just not consulting companies

4 Year Bachelors in India + 5 years of Exp (excluding sponsoring emp)
3 Year Bachelors in India + 2 Yrs(Msc) /3 Years(MCA) + 5 years of Exp (excluding sponsoring emp)

Unfortunately, country of birth for PD determination is one thing that cannot change. It is ridiculous that a country like the US that promotes itself as a meritocracy and a country of second chances ties the fate of EB applicants to such an immutable parameter.
I used to believe in and respect the so-called the American Dream. The more I stay here, the more I see its hypocrosy. ;)

I believe that there is a great flaw in the way the USCIS allocates VISA NUMBERS among EB1, EB2 and EB3 which is very much evident and if we can stand united we can get something done.
After carefully observing the trend in VISA approval and VISA bulletins, It is a reality that EB3-I is not moving and at the same time EB2 and EB1 are moving fast in relative terms and probably may even become current ( EB1 is already current ), But one thing USCIS is clearly not considering is the Priority Date, which basically means that they are not giving a damn thing about how long the person from EB3-I is waiting for. Here is my suggestion and some of the IV representatives need to analyse what Iam gonna say and see if they can stand up. Being an EB3-I india myself, i totally agree that EB1 and EB2 should be given a weightage and some preference over EB3, but I dont agree to what USCIS is currently following, EB2 With priority 2006 getting ahead of EB3-I with priority date 2001. This is ridiculous and to even think about it, it just sounds stupid. What they can do is , They can move the Dates in both Categories while giving preference to EB1 and EB2 first.
Please dont jump up & down before i complete. Iam just giving you an example of how things should work and how they can move dates forward for all 3 categories while maintaining that EB1 and EB2 gets preference over EB3. Let us ignore Eb1, since it is already current. Now Coming to Eb2, the priority Date is 2004 for them.Ideally speaking, They should not move them ahead until atleast EB3 reaches 2004. But once Both EB2 and EB3 reaches the priority date of 2004, Obviously EB2 gets the preference over Eb3 and EB2 will start to move ahead but not by much, let us say 1 year. Now, Clearly, EB2 is still given the extra preference over EB3 but at the same time, we are maintaining the priority dates between EB2 and EB3 as close as possible so that the system is not totally unfair to EB3 filers. I think, as one of the un-biased Organisation we should stand up against this unfair treatment in general. I hope even EB-2 will understand what iam trying to say.

seekerofpeace - I hope they have not lost my file. I have not been able to get a concrete answer so far as to what is happening with my file.
My attorney had filed 140s for in EB2/EB3 and I hope they have not taken my app and classified it as EB3. We sent the EB2 I-140 with the AOS app so I dont think that would happen but stranger things have happened with USCIS.
Response that I got from the local senator and from what I read in the other thread you created, I think visa numbers are over for 2009 fiscal year. We will now have to wait until October. I dont mind waiting until October, but I want to use the next 15 days doing whatever I can, so atleast in October, I have some chance of getting approved.

There was another LUD for all three of us (Self, Wife and daughter). Also received a CRIS email for wife with an RFE. I hope this RFE is about her incomplete vaccination at the time of filing. Will post the RFE details when I receive them from attorney.

3. In worst case, during the judgment time they will consider your family, two kids. They are not heartless people and it�s just an accident. That guy must be insane to ask 3.25 million. I couldn�t believe the whiplash injury especially when the damage was <$1500. I just assume the impact must be very minimal.
My advice is, don�t lose your hope and sleep. You insurance company is there with you to defend. Keep in touch with them and respond promptly to court notice or any letters. You do not need to withdraw your GC. Worst case if everything goes against you declare bankruptcy and leave the country legally. So if you want to come back in the future, you won�t have much problem.
When you don�t have anything to lose�why do you worry. Keep it cool and every thing will be fine. Seems like those guys wanted to have retirement with your money.

While we all appreciate the contribution Aman has made for this noble cause and we are thanking him left and right on this forum, that is not the real appreciation of his sacrifice. Just saying thank you Aman; good job is not a real appreciation of his sacrifice by any stretch. If you guys really appreciate what Aman has done for us, please show your appreciation by making contribution. If Aman spent $64000, the least you can do is spend $64 on this noble cause which Aman has been fighting for all along.

EB3 India is in a bad shape because of lot of backlog. I do not see relief for people with latter PD in many years to come.
EB2 India is also not expected to have good movement for the next few months.
So people who spend time on sites to track are wasting their time in my opinion.
IV is people affected and not just core members. Core members , chapter leaders also have their own jobs that pays salary and life and each one of us can only devote so much time to IV. The best strategy for all of us is to work on resolving the problem and not leave it for others to deal with it.
What each member can do:
1- Take part in IV action items. We currently have a couple of bills. There is a slim chance with this bills if only we can get more cosponsors and get CHC support.
2- Raise awareness of IV. More members will mean more people will take part in our campaigns.
3- Contribute to IV. We have a funding drive that is currently begging for attention. With meager funds we cannot even afford to do our limited lobbying.
4- Be an active IV member: If nothing at else, be regular on IV. More visitors on IV means more revenue for IV from banner ads. This revenue is used towards lobbying and website maintenance expenses. Other sites with banner ads use that money for their own, but IV uses that money for lobbying. Several thousand visitors everyday means a good amount of money generated via ad revenue ( I could not believe it when I heard it the first time). If you like tracking, then use IV tracker and help make it successful. PLEASE Put your real dates in your profile.Money from ads on it will be used for our lobbying .
5- Develop state chapters furthers. members can get active and build their state chapters further themselves. It can be great for making friends and networking too. We want to develop this further and need member's help.
6- Do not leave IV when you get your greencard. IV is a community and be a part of it. Help others who are suffering like you yourself suffered once. When we have lot of greencard holder members, we can even expand the scope of our work and include items like 'I140 approval date should be counted as a date for 5 year citizenship eligibility' etc...
7- Consider IV as your home and join the effort in whichever way you can. Bring in new ideas and take leadership to implement them.

Though it is proven time and again that CP filers are the least needed people on this forum (next to EB3 I - going by this thread), it is unfair not reserving few columns on the profile for CP filers ... It doesn't cost VISA numbers for that...

In my opinion, the biggest sufferers are people in EB3 India or China and who have opted for CP (now guys, don't start lecturing on CP vs. 485. We have heard it enough).

But i bet you ..you will find your self in the same situation of agony and endless waiting for the final Green card.
I bet most of the people don't use your ead and AP as it puts you in a gray "Adjustment of status". They are good to have though. But you will see...how painful it is to decide to use them or not..
What i want to say is that being able to apply for EAD and AP is not the end of the battle..you will be stuck in a depressing situation waiting for the final green card.How do i know? .. I went through it...waiting for GC for the past 4 years.
I dont know its FBI or its just the USCIS incompetence but waiting in the final stage is horrible. Every time you travel you are scared...AP as for as my lawyer goes IT does not guarantee 100% entry in to the country.

I agree. The short term relief will be short term. After a year or so we all will be frustrated with the delay in getting GC as that point we will already be tired of renewing EAD (and Advance Parole??) every year. We must work on capturing the unused visas. Otherwise the feeling is correct, no GC for several years after filing.
USCIS allowed filing but there is no guarantee they will open those envelops and starts working on that. They have a good excuse and that is called THE BACKLOG. I think we should suggest Dipa Nair to make a move named "The Backlog" and I am sure bollywood in India can do a nice entertaing job for that as well.

What i am saying why dont we try for the overall improvement of the GC processing. Why dont we be firm about not wasting the GC numbers and recapturing the unused numbers.
We had a small revolt (peaceful way) and its successful.We dont want to stop there.

I agree. The short term relief will be short term. After a year or so we all will be frustrated with the delay in getting GC as that point we will already be tired of renewing EAD (and Advance Parole??) every year. We must work on capturing the unused visas. Otherwise the feeling is correct, no GC for several years after filing.
USCIS allowed filing but there is no guarantee they will open those envelops and starts working on that. They have a good excuse and that is called THE BACKLOG. I think we should suggest Dipa Nair to make a move named "The Backlog" and I am sure bollywood in India can do a nice entertaing job for that as well.
