Folks,
There are many discussions on immigration (some in favor and some totally misrepresenting the legal immigration).Mind you many of the ordinary citizens are voting on these posts, which indicate the popularity. Obviously this is one way of increasing the popularity of posts highlighting our case (ala Digg)
Only a few of the immigration posts are addressing our pain points. One eg is something like: Please help the Immigration System
Please vote for them and champion the advantages for all by commenting and voting.
I believe at the moment this is achievable by all. Please act!

Hi All,
All this memo states is that USCIS will not automatically expedite the FBI name check simply because a writ of mandamus is filed. This memo signaled a national shift in the way USCIS responds to these types of lawsuits.
The U.S. Attorney's Office will now fight the writ of mandamus lawsuit by filing Motions to Dismiss and Motions for Summary Judgment. While this obviously lengthens the time it takes for a case to proceed, it is still very possible to win and force the government to adjudicate the application.

I just looked at my old cases(H1Bs-I-129) and i see LUDs on them too!!! This is so weird.
These are from my last company!
LUD on 05/06/2006 - Approved on October 11, 2003
LUD on 10/21/2007 - Approved on March 19, 2002
I see LUDs but no difference in the status. They both say approval notice sent.
whats your PD and 485-RD? Maybe your case is close to approval and they are just looking up older H1s

You mean EAD, not AP, right? AP can be used in conjunction with EAD.
Also, you can file for both EAD and AP and not use it. Just having the two will not force you to have 1 year extenstions. You can still get 3 year extensions if you don't use EAD and AP.

An MBA from an accredited AACSB university is a good investment for the long-term. However most such schools require a good GMAT school, require 2-3 years of part-time classes and cost anywhere between 30k-50k. I know there was a long discussion about this a while ago. My PD is in 2005 in EB2 category.
Any guesses as to how long it will take without any reform? Is there a good guess on the total number of pending LCs in the queue? I would like to take that number and divide by 1400 (2800 for EB2/2).

More likely cause is that the letter from the applicant notifying his new job never reached/registered in CIS systems.
Did the person send the letter in time? Was there any intermediate change in status between NOID and actual denial status?
AILA should file a lawsuit regarding these denials. They expect people to follow all H/LCA/PERM and target employers/lawyers to send a message to other people but fail to follow their own laws themselves. A lawsuit causing hardship needs to be filed. I dont know why AILA has not taken any action against this practice.

Please channel your energy, we need it now more than ever now. Noises like Lou or O'reilly will always be there. They are good source of revenue for these news channels so most likely ur pettion will fall on deaf ears. Moreover, these guys can use these things against us and we cannot afford to open several fronts at this time. SO Ignore them.
I plan to send this petition to all senior executives of Time Warner Inc by Priority Mail and Fax. CNN is a fully owned subsidiary of Time Warner Inc.

Actually, not all he said was wrong.
We should not support what these IT consulting companies are doing with H1B programme just because we are on H1. These big companies are hoarding H1B visas so they can have an upperhand when dealing with the employees.
My own employer was trying to get as many H1s as possible without having ANY work for them.
This is also due to the fact that because even they have no work for all the H1B employees, they file for H1Bs in bulk, for they know that they don't have to pay people on bench, even though by law they are supposed to...
But most importantly we are concerned with visa recapture and GC reform in the long run..If H1B reform is the step towards that goal then that would be good..

I totally support banishing country quota. It is totally unfair specially to folks from India/China/Mexico and others (in EB category).
However if we analyze the current mess. Following are some of the things that led to it
First of all 65K is the number of H1-B's that are issued every year. Lets assume all of 65K applies for GC >> then we get 65 K * 2.2 (dependents) = 143K GC's.
Then how come we have such a big backlog.
1. H1b visa ceiling was increased to 195K during the tech boom of 2000's but they never increased the EB based green card (it remained 140K)
2. Wastage of EB visa by USCIS. Some estimates are in range of 500K. But let's say they wasted half of it (250K). This should be sufficient to clear the backlog.
3. Third of last few years with rise in economies of India and china and ROW, we have seen an increase in the L1's (globalization). I totally agree with this and have no issues with L1's. And many of L1's decide to stay in US. And of course GC comes from EB category.
Simple logic is H1-B non-immigrant visa has been recognized as dual intent, which means holders of H1B can legally apply for GC.
On the other hand Congress and US govt have failed to provide adequate GC for EB. The system is a total chaos now for all the above reasons.
This is what we need to communicate to congress/us govt and if required challenge in court.

I would think IT experience is the same anywhere so taking it to canada should be ok? If not there are plenty of other management jobs there. It might be a new start but in a one year timespan you will be well established.

I would recommend comprehensive coverage plans for parents. As far as I could tell, there is only one website that sells coverage with pre-existing conditions rider (KV Rao's India Health Network), but that is a limited coverage plan. They have daily limits on most of the hospital charges, but the hospitals usually bill you 3,4 times those daily limits, so you end up paying for the difference out of your pocket. I know this, because I have had first hand experience for my father not too long ago.
So always go for comprehensive plans even though they are more expensive if the parents have any kind of health issues (given their age, who wouldn't !?). Comprehensive plans do not have daily limits - you are only limited by the policy maximum. You are looking at at least 60-80k bill if the patient is in the hospital for 3,4 days; so go for at least 100k coverage.
The way I would look at it is, visitor medical insurance is a lot like auto insurance here. We all pay for auto insurance every few months, and we are very happy if there are no claims against that policy, right? Same thing with visitors insurance too -- buy good coverage, and be happy if you didn't have to use it. That's a small price we have to pay for the pleasure of having our parents around. :-)
