I got a Soft LUD too on March 25th,2009. Probably routine scanning of applications to check if all documents are there or not. My receipt date is July18th,2007 btw.

Hi Gurus,
I need an advice from you.
The situation:
-- Involved in a collision few months back. As I had rear ended the vehicle, as per the investigation, it was found it was my fault(80% mine - 20% others)
-- Now after more than 18 months, I get a law suit for 3.25 million dollars(. This was served against ppl who were involved. Right now my I have my EAD and AP and maintaining H1 status.
So what are my options now?
1. Check with attorney and start defending..?
2. pack the bags and go back to my country ? If so, will there be any issues in coming back again, say after 3,4 years?
3. What about my GC?
Any help would be greatly appreciated and I guess it would be a biggest decision of my life ..

What's your insurance coverage? It seems you had rental car. Have you taken the rental coverage at that time?
Send me PM and I can ask my friend, who was invloved in big accident like you. Insurance company will fight for the last penny and after that you have to pay, if it is not covered.

Yes a new memo was issued in 2009 (After DHS confirmed that they have worked with FBI to reduce the response time.) Now since FBI claims that 90/95% of the requests are happening within 6 months. DHS/USCIS is not allowing automatic approval of GC is FBI check was the only peice pending and was pending for more than 180 days.
I went to Infopass today, unfortunately service rep on counter was totally uncooperative. She did not tell anything other than my background check is still pending. As per my estimation, it has been pending for more than six months now. I understand that my PD is not current as of yet but, based on recent movement, I hope to have my date current in next couple of months. But, it may not help me much if BC is still pending..
Any suggestions from IV.. What can I do about it? I planning to get in touch with my attorney but, I don't think they can be of much help..

no my address on I-485 wasmy phisical address not PO BOX but I got my welcome notice last week to my PO BOX but the address on it is the physical address I hope this is clear the only mistake is that I didn't mention to the officer at the time of the interview when He asked about my address I didn't mention that the USCIS if they send me anything to my physical address that they have to add the name of my friend with the C/O my name

I called my attorney after seeing this thread. This is what I heard from him.
We have not received it back from CIS. We have not received any of them back that we filed. CIS said it will unequivocally reject them. But as of Monday they have decided not to send some back (many were already sent back) pending some internal decision-making about how to handle them. We would let you know if anything happened.

Not true...
In the EB base, only 1 GC is counted for all family members. How can it count more than one if it is a derivative of an employment visa? It might count against the Family base even though primary applicant is EB-based. Not the other way around.
If they dont count Dependents we all get GCs very soon . Unfortunately all dependents even kids are counted under employement category ..
One change - Counting a number for primary applicant can change thousands of lifes each year .

Ok, so here are some more thoughts ... obviously we are all stuck in our current positions and we are worried about the future. Unless, we do something to be prepared we won't be better off when we get our GC's? Given where most of us are I think we have two options:
1. Advance your education (MBA/PM/certifications etc.)
2. Start a business.
I would like to hear from everyone who has or wants to start a business.
1. Have you thought of starting a business?
2. What does it take to start a business while on H1B
3. Is it worth the effort not knowing if/when you will get the green card. Remember starting a business is not a short-term goal.
4. Are there businesses that cross borders i.e. we can continue to run the business even if we have to leave the US?

Oh yeah .. but that is provided I can file my 485 by that time. Given my PD was just May 06, I had NO preparation for 485 filing, wonder how much time gathering up all the required docs takes for this filing :)

My H1B going to expire Jan 2008. I am not planning to renew it. My PD is current (india-eb2 2004 jan). I am planning to travel in March 2008. Do I can travel with AP, without valid H1B papers. ? Do I need to renew my H1B ?

You should have AP approved to travel in / out of USA, and valid EAD to work after your H1B expires (though you continue to work for the same employer). It is recommended to keep H1 status as long as you can, just in case anything happens to AOS - Again, it is a personal choice to renew H1B. I dont forsee any exit/reentry problem due to not renewing H1B. Good luck!

even after entering US on Advance Parole.
Followup questions:
1. Is the I-94 # on your New H1B Approval same as the I-94 which you got
when you entered US on Advance Parole?
2. I am sure that your Attorney might have mentioned that last manner of
Entry into US is "Paroled" when he filed for your H1B transfer.
Please confirm this.

I agree that MBa can help your career but I am not sure what kind of return I can get for 3 years and 50 K.

In my opnion starting your own business is always a good idea, of course with uncertainities with GC process it is another risk added to the enterprise.
In my opinion, doing an MBA from a good school can open up doors to further growth in a comapny. With jsut technical skills it can get stagnated.
Age should not be a restraint, but with age comes other responsibilities of familiy etc, those could be more limiting.
I think doing MBA from a good institute is good idea, India is really humming and has lot of growth opportunities for MBAs.

hey h1b_alex..very sorry to hear your situation. If you feel I am not asking for too much, can you name the company? That would help a lot of people who can avoid getting in trouble in the future.
