Don't bet on this too much. Not being pessimistic, but in a democracy it is not just what is done but who does it and how it is done. Why should Republicans in the outgoing Congress vote again on a bill when their majority status is obsolete now? Do you think democrats will allow this outgoing congress to take the credit? they are politicians too, anything crappy in that bill is going to be the new Congress's (read Democrat's) burden. Already, a bombshell is waiting in the form of a hastily passed by the house_hastily signed by teh President bill: there is a fine print that removes oversight of how money is spent in Iraq (at least some of it). So, there may even be review of hastily passed, pre-election bills. anything more like this is going to give this congress very very bad name and the next congress a really bad headache.

I did a quick search and did not find answer to this. Apologise if this is a repost.
But a co-worker of mine wants to travel on AP. After coming back, he will join my company (right now he is a contractor) as a perm employee on H1. Is it possible and allowed? Can he transfer H1 after using AP?
Our company attorney confirmed that his H1B will remain valid even after using AP. But she is not sure about transfer. I will post her reply once she gets back to him. But in meantime, if anyone has any idea about this, please share.

This is how it works. If you file for your 485 now, the next thing that is expected from you is to wait for the receipt, that would take 3 to 4 weeks. Then you will get finger print notice, that might come in three months time. Once you are done with all this then check the processing date of the respective service centre where you have filed your 485 application.
Now coming to the question of unmarried filers, if the principal aplicant's date of marriage is beofe his or her 485 adjudication of adjustment of status, there are two ways principal applicant file for 485 for his or her spouse. The spouse can travel to US on H4 and file for 485 or the principal applicant can do consular processing. Now consular processing is good for those cases whosw w PD is current but since retrogression can kick in anytime it is better to travel to US on H4 and file for 485.
Another important aspect is if you file 485, EAD, Advance Parole and you use EAD, you loose your H1 status, hence on EAD you can not bring in your wife. So unmarried filersn it goes like thisn you go ahead and fileyour 485, then go to your home country brng in your wife on H4n as you have aleast s months of time if NSC, TSC or CSC 485 processing is not current and it is hown 1 month for receipt of 485, three months of time for getting the finger print notice and you can postpone by another month of FP by rescheduling it to another month. So literally you have 4 to 5 months to get married and by that time the dates will retrogress again. So dont worry, just go ahead file your 485 and start looking to get married. But try to bring in your spouse asap so that you can file for your spouses 485 also till the time PD is current. If you are not able to file for 485 for your spouse and you have filed for yourself and whenthe dates retrogresses again when your spouse comed to US you would not be able to use EAD as using EAD nullifies H1 and H4 status. So desi consulting companies will keep on sucking your blood as you cannot change job using EAD. This is 100% incorrect that you lose your H1 when you get your EAD. You can maintain both the status and use H1 for your employement. You can maintain the h1 unless you use AC21 to change job. Check with your attroney for your scenario.

I went for the visa stamping in chennai consulate on Dec 5th. After a few questions, the officer granted me the visa and said i will receive the passport in a few days. But so far haven't yet received my passport. Does anyone know what is happening? is anyone faced such situation before? I heard about this admin processing and delays in stamping but i thot the officer would usually give out some kind of form to you during the interview if your case goes thru such processing.
The web-site says we can send an e-mail to the consulate regarding any questions for NIV if it's pending more than 5 days. Has anybody done that and what would be the response?

Why dont you call VFS and find out what's happening and if they can help you to resolve this?
I might have more information than VFS. The VFS agents don't know what's happening in the consulate. The agents doesn't know more than what is already present in the VFS website.

It is very difficult to make a prediction...The 7% country quota for china is satisfied already...So it could be this october
The only chance that it happens is that visa overflow from other categories into EB2China/India...For that to happen..Eb3 world has to become current.....
That would mean that more visa are available than can be used for Rest of world...Then CHINA/India would get some more than 7% country quota....
So it could be Oct 07 or if you are lucky... earlier....
If immigration reform happens..you would definately become current immedialtely...

Believe it or not, I know a consultant who lives in one of those "guest houses" where consultants who come from India are housed, and there is a guy who lives there whose job is to cook, clean and buy groceries for the housmates. HE HAS A GC APPLICATION PENDING! And people like me and many others who truely deserve to be hired and retained in this country are facing an uphill task of getting through the GC process.
That cook guy came to the US with a Bachelor degree in commerce, called B.Com. He hasn't been able to get a project for 4 3 years now. He doesn't get paid by the company. He is just a freeloader living there.
Imagine how many suck "cooks", "maids", and gas station employees might be out there clogging up the system!
I don't get this. Who is sponsoring this person's GC? He must have a sponsor to get the EB-based GC. He can't show his job skills as cooking !!:)

Those who got labor sub and got their GCs already must reapply within XX days or their GCs will be deemed invalid? How do you think will such a rule be?
If labor substitution, applying 140 in 45 days etc.. are the kind of rules that are being framed, it is mainly because all the companies started exploiting these rules.
It can be hypocratically argued that Desi companies only sell labor and misuse it, but from a larger perspective, any company including those multibillion dollar companies may actually misuse labors ie like HR will use sub labor for friend, lawyer may educate HR about the loophole and they will use it as a card for new hires. If such a thing is stopped there is no room for misuse of any form. We have to thank Desi companies because in someway, by totally exploiting the loophole, they helped this cause.
45 days in filing 140. Believe me, such deadline is definitely achievable. 140 is a simple process and all that is needed is company audit and tax reports. I guess time will be given to those who already have labor certified and not applied for 140 for whatever reason.
Such a rule must come even for filing 485. So that companies don't drag that too.
Like most of the people have told earlier, changes are coming, a lot of changes are coming in the system and people are working in the background to streamline the system.

PHDs - EB1 dont make the kind of cash you have shown (ask the post docs who are working there asses off), similarly EB 3's are not restricted to the range you are talking about.

Throwing money at scholarships and education incentives dont make people choose a profession they dont like. If they want to be lawyers and doctors and managers, they wont force themselves to go for tech degrees and diplomas just because they get thousands of dollars in scholarships.

I am 2007 PD EB3. I know i am screwed :-) , but our discussing out unfortunate luck here , wont change it.
I am not even dreaming about my GC. I am just enjoying my life today, as i have no control over tomorrow. The irony , i was qulaified for EB2, but my lawyer didnt want to do an extra work(BS + 7 Years) , so he put me in EB3.
Let EB2 get there GC's first , and may be the illegals also get it before EB3, I really dont know the point of discussion of this thread.
Thank God somebody didnt write , thats its really unfortunate that we were born in India.
