    As per our lawyers, right now USCIS is in the process of entering our applications in their system (for date of receipt and such). There was a memo from USCIS saying that they will be done with the job of data entry by August 1.

    From August 1, we can expect either rejection or acceptance of the actual application. The hope is that a court/congressional intervention before August 1 will change the USCIS action of rejection into acceptance.

    Is it correct to say only nebraska Service center is issuing the rfe because they are pre adjudicating while Texas service center is not issuing rfe because they are not pre adjudicating 485. A vast majority of people getting rfe on 485 (95% or more) are from nebraska Service center.

    I talked to my lawyer today about what he thought about this new development and he indicated that there might a court challenge to this new rule. Now from a lawyer's and employer's point of view, I can understand their frustration and they certainly have the money to drag this thing in the court for a while but the question is will they? And if they decided to go to court, will the new rule be halted until a decision is made by the court? He indicated that the least the lawyer's and employer's might accept is to exclude the existing approved labors from being affected by this new rule.

    Let's all hope that they don't succeed; otherwise this new rule won't help us as much as it could.

    I think US experience will hold good in canada, at at least in IT. Canadian experience matters for immigrants who directly come from their home countries, never having lived in north america before. The trick is to find a good enough job for your experience level .. what is the point of going there and doing the same kind of job that you were stuck with here ?. That is easier said than done given the limited size of the canadian IT industry. I second your thoughts if you do get a good job, an year or so should be good enough to establish yourself. I fact, I know a couple of guys from my area who moved to canada with their families to escape retrogression, and are now well-settled there with no intention of ever coming back to the US. But yes, it took a while for them to find those jobs.

    I think rpatel is right. This what I heard from one of my buddies who moved to Canada in 2003 and recently got PR.
    Canadian firms prefer Canadian work experience. This doesn't mean that your past experience doesn't count, just not that much

    It is very difficult to get a bill passed in House for increasing visa numbers. Be it legal or illegal there is no way House will pass anything that increases visa numbers this election year. I am doubtful even for next year.

    For this year or for now we should just get something like "ability to file 485 even when visa numbers are unavailable". This is something which will provide some relief to all of us and has good chance of going through. Subsequently we can keep trying to get the SKIL bill passed next year.

    Absolutely. Now with PERM and premium 140, if we can file 485, and then hit the snooze button for 10 years -- no problem for me. I know, not everyone will be lucky to board onto the PERM, but atleast it will be relief for most of us.

    Excellent point. It is called the Selective Service System (Selective Service System: Welcome (http://www.sss.gov)), used when the President orders a military draft (like the ones during WW2 and Vietnam war)

    You have to register (males only) if you become a Permanent Resident in the ages 18-26; otherwise you could have problems during naturalization (N-400 has a specific question for Selective Service) and securing Federal Student Aid.

    Given the backlog and mess...i wonder how many will be 26 and below. Mainly applies to family based immigration.

    I understand where you are coming from. And I am sorry that some of my recent posts were irresponsible.

    Frankly, after mumbai attack I have been a different person. I come to this forum to learn and provide any information I can provide. But it bothers me to see few jerks like mirage who don't have any clue of how things work, and they just start posting on the forum "remove country limits, remove country limits, remove country limits, remove country limits, remove country limits, remove country limits, remove country limits" 30 times a day, as if that will be sufficient to remove country limits. And in more ways this uneducated style bothers me. I will try to ignore it and go my way.

    I am right now going to speed dial that other side of me, good and informative side.

    For all the non-financial enginners who are trying to make sense of financial jargons (like myself - no financial enginnering degree for me but I have worked as a quant for some time in between):

    Any time you are trading something - you are betting on the direction of "something". Smisachu - with his statistical arbitrage background - would probably like to vehemently disagree at this point. But please hear me out first.

    If you are buying a stock - you are betting that the price of the stock will increase. If you are not sure whether prices will increase or decrease - but still sense some bubble forming, then you know that at the top of the bubble and duing the bust phase - the volatility goes through the roof. Maybe it is time for some option trading to trade on the volatility. So you are now trading on the volatility instead of the price.

    If you become even more of a pro option trader - and you think that the market always undervalues out of money options (because human brain is not capable of anticipating the "black swan" events) - then you will buy out of the money options for pennies and will hope that you "poo like a chicken and eat like an elephant". The directional bet you are taking in this case is again on the vol increasing over a longer period of time.

    If you are into statistical arbitrage - you have your own gold standard, usually some mathematical model, of how a specific market should be priced. If the market price differs from this - then you enter into a trade to make money when eventually this anomaly reverses.

    Volatility is the second order "statistical moment" of the price. These, and other derived quantities (are usually termed as greeks in the trading perlance) - but if you are good in statistics - then you could think of all of them as statistical moments and formulate your whole mathematical model on that. There are ways you can formulate strateties to trade even higher order derivatives.

    The basic fact that you are betting on the direction of "something" is often lost on even some professional traders - leading to some wonderful illusions of risk free return (like perpetual motion machine).

    To be fair - there are some trading strategies which appear very simple and intuitively appealing - yet produce extremely complex mathematical results when you try to find out exactly which "something" you are taking a directional bet on.

    So if you want to trade - I think a good idea is to first find out what is this "something" that you will like to bet on. Alternatively, if you have any strategy - please first understand what kind of direction bet you are taking - and the risks associated with it.

    Any thoughts?

    P.S.: "Directional bet" is a dirty work in trading perlance. I used it intentionally for effect.

    What you said was absolutely correct. However most of the times the delays caused in big companies are due to various layers of communications as well as approvals.
    I'm a live example of how i lost the opportunity to file 485 before Dec31/2004 for EB3 category, just because of unnecessary (so called) procedural delays
    NOw, this new rule in place will certainly prompt for good changes in the big companies if they truly want to sponser GC
    Yes, they must act in a timely manner. one way to do is HR should get all the necessary approvals from managers / directors so that they don't lose time. Secondly my observation is there is always a substanial delay at Attorney's office(few exceptions are there) to prepare the paperwork.



    I dont think companies are really geared to file for 140 within 45 days of labor approval.

    Most of the companies take 4-6 weeks to just send the documents the lawyers request for filing 140. Then the lawyers, most likely forget something and request more documents. It takes another 2 weeks for company to send those.

    All in all, on average I think companies need 3 months after approved labor to be ready to Fedex that 140 petition. No malicious intent on the part of employer, its just how things are. 45 days is going to make things difficult for many companies and many of the lazy, slow, procrastinating law firms.

    Just because a large number of IV members are EB2 Indians (based on the comments posted) doesn't mean that we should ignore the interest of EB3 ROW or EB3 Indian/Chinese.

    Any talk about moving visa numbers from EB3-ROW to benefit EB2-India only divides us therefore should be despised. Let's focus on the real issue (supply & demand of EB visa in general) and serves the interest of all people suffering from this.

    However, everytime someone talks about giving visa numbers from EB3-ROW to EB-2 India/China as the ONLY freaking thing in the world to do, I have to point it out to them that they are talking taking those visa numbers away from ROW-EB3. And that my friend, is not in the interest of ROW-EB3. Nor does it benefit India-EB3, or China EB-3.

    When I am trying to reqruit someone from dice, I see resumes that are heavily bloated to an extent. I see similar resumes with names changed and some words changed both from same city, so maybe they are from same consulting company, i have to dig through in detail to figure out a good resume and finally the chances are that I may have gone through a bloated resume are high.

    One suggestion that is in above post is good, INS can releease skills associated with filing h1b petition and match with skills on resume.
