If you changed the project and the new project is giving better hourly rate then if you are working on percentage basis, your share will go up.
And in this case if you have a labor and I 140 approved, will there be any problem?

The dates will retrogress again as USCIS realizes the mamoth amount of applications for EB2 - India that are in the pipeline which they may not even have accounted for yet.
We are in for a long wait unless we get admin fixes or legislation...

I aggree totally. This forum somehow started with a lukewarm response to the issue. Two things come to my mind.
1. The folks are not aware of the issue (or)
2. Most of the folks are just at the first stage of the process and think that retrogression is the only bottleneck.
Please add this as the one of the hot issues to help one and all.

Very interesting. When we applied for 485/EAD/AP, our lawyer specifically asked for color passport copies of the first few pages. I went ahead and made copies of all pages. Am I in trouble?
Lawyer may be more knowledgable, but here is pointer to User Manual.

After reading manaul and knowing that kinko prohibits such copying, there is some fact in it. It may happen that color copies of documents in some countries are not allowed, but for some other countries, they are allowed. I am an engineer and I don't have more information (pointer to sections of legal books).
Since I make copies at home, I follow user manual information. If my Lawyer asks such thing, I would show him the information and ask for clerification. If he overides, by give me clauses and sections, I would't hesitate for him. Laws keeps on changing.

Because you guys are not as clever as EB2s.
you sir, certainly are not as smart to file in EB1. more ever its not about being clever it can sometimes also be a company policy, the exp, the qualification. There are plenty to shops that do not entertain EB2. EB2 or EB3 hardly makes a difference at professional level. Its only a counter in GC.
Once this is all over, an EB2 case just might be reporting to an EB3 Manager.

I opened the mailbox at home this evening and to my complete surprise -- the physical card! Sudden burst of efficiency at USCIs, 6 days from approval to actual delivery of card.

May be you scared the USCIS with your phone calls and they just wanted you out of their systems. So that you don't rally other people and then they might have to really become efficient.:cool:

But when that happens, I guess, guys in CP wil get their interview scheduled (as long as their PD is current; no RD date concept there) as the queue in CP is not as long. Correct?
In general CP ones get out of this mess first always... I know you are CP one and you would be out well before the guy having same PD but stuck in AOS.

Did you confirm whether they received your RFE? You can go to Infopass and also talk to second level IO just to make sure that they received your RFE.

Hi, I see that several June 1st filers who mailed on 31st may have received RD's. So same logic should apply for July 2nd filers who mailed on 30th june. I dont see any difference between the two scenarios. Any rejected july 2nd applns should have already reached, unless they are lost in return mail :(. Otherwise the scenario is exactly identical to June 1st filers.

Well said anurakt! I did the same - recently changed my job and restarted the process. At the end of the day better prof. experience will give value add - not an immigration status.
Having said that - I support IV and stand by it. I admire the attitude and am proud to be a part of the group. The immigration situation is very frustating but I'll not allow it to 'control' me.

It took a while for me to understand this situation. Now I am very clear on what I will be doing istead of tying myself to a bs immigraion system this country has. I ran after two things GC and Money ....running after GC didn't do any good....stuck with an employer.... salary below market value same position all the years....but I have decided I will run after money now.... so in current situation I have more money better position...less mental stress .... If I get GC... good ....else I will go back to my country with total financial freedom. Make my money as quickly as possible. We are all here for money and nothing else ...thus GC should not be an end to life....

How can USCIS adher to 7% per country quota when AC21 explicitly says that if visas are still available after allotment to ROW, the remaining visas must spill over to the over subscribed countries?
As a result of failure of this lawsuite, if they start adhering to 7% cap, then they are in violation of AC21. That would be another lawsuite for sure.

Nice read...I own a home too. If I have a GC now, I am in a position to pay off considerable amount on my mortgage. I know its a drop in the ocean but I am sure there are lot of people like me.

Ok guys before you shoot it down heres my calc for EB2 pending apps from 2000 to Dec 2003. Obviously its a rough estimate, who knows how many eb3s switched, labor subs etc etc etc.
From pending apps from 2000 to 2003 dec are about 96. Assume represents 1% of total population so it would be 9600. Each app has about 1.5 dependents so about 15,000? If you assume as lower say 0.5% then number would obviously increase to 29,000.
Ok now shoot me down.

While your concern is genuine, our experience says it is not that easy to remove country quota with a 2 line bill. IV will advocate for it, but understand that it will not happen in isolation and it is not feasible in an isolated bill.
In the current economic environment, removing country quota seems like the only argument that can fly, since it does not increase actual visas.
