    Dear IV Members,

    If you believe that your success depends on your immigration process - whether it's the ability to file I-485 earlier or to get green-card and citizenship sooner or whether it's the ability of your spouse to work - then you have to believe that your success somehow depends on the success of Immigration voice and these 170 volunteers in DC next week.
    As you may know, we are just one more week away from hosting Advocacy day in Washington DC where about 170 members of Immigration Voice will conduct nearly 250 meetings with offices of Senators and Congressmen. Such events cost money. If we have enough contributions, we can spend as per our budget of nearly $ 50,000. If not, we will have to cut back on the event spending and reduce the magnitude and size of the event.
    If you are not coming to DC next week, please do your part and contribute funds to Immigration Voice. It not only finances the event properly, it instills pride and confidence in the members who will be there in DC that there are thousands of willing supporters behind them who could not be there physically but are 100% with them in their determination and resolve.

    Good Questions. Would you be willing to jump into the field and start motivating people to be part of IV and be actively involved in IV Action Items?. Would you be willing to find out what is stopping people from getting involved with IV?. We are always short on Volunteers to work on IV Activities and we definately welcome newbies willing to work for this cause. We have a few highly dedicated volunteers who spend time educating other people about IV, forming state chapters, recruiting members into state chapters, organizing chapter events, raising funds and the list can go on. These volunteers have 24 hours in a day just like everyone else and they have full time jobs, families, careers, schools to attend etc. Would you be willing to go out and recruit volunteers for us?

    I agree with the reasons behind it, now that I know it.

    Just so, everyone understand, I am not trying to find fault with IV or its members. I am trying to do, what you can call, soul searching.

    We have around 25000 members. Why only 25000, when we know there are millions out there in the same boat. What is stopping them from joining IV and contributing? Of all these 25000 or so members, we only have around 4000 letters sent for Admin fixes.(May be I am wrong about this number, but I believe it is around that range.) What is preventing the others from doing so?

    I strongly believe, that the answers to these questions might help IV in the long run, with more members and possibly more active members. Once we get to that point, IV will no longer be an organization, but it will be a MOVEMENT. Chances of success for a movement is always better than that of an organization. That is what I believe we should try to achieve. I hope everyone agress with that.

    You are saying new OBAMA govt. in many of your postings. Are you his election agent?. This forum is not for any party affiliations. Election is yet to start. Democratic party is not officially announced their candidate. All powerful President Bush is tried hard to help immigrants. Then how come a weak person who is still fighting for a ticket can take left and right congress and senete veterans.!!!!!!

    What are you talking? which part of the world do you belong? Obama is the democratic candidat for 2008 Presidential Elections Its conformed.He is not still fighting and also he how can you justify that he is a weak person? do you know he was no where in the picture and no one expected he will won the nomination when the Democratic Primary was begun..now he is the democratic PRESIDENTIAL NOMINEE..by now you should have undestand how powerful he is.

    it's a "skin" if you were to wrap the thing celophane with your design you wouldn't see the wheel or the screen... I say play with the screen, the button but not the wheel. besides, you would rub it off in one day and then it would reaaly look like arse.

    Obviously you've never seen an iPod skin. It does actually have holes in it for the click wheel and screen.

    We are all protected under first amendment (freedom of speech) so one is free to express their opinions. However I must say that IV never promises to come and get quick solution.Per my understanding it offers members to come share experience decide on stragtegy and with colloborative effort we can surely make a difference.Now if IV is not able to desired result which emans we asa member are not playing our part which we were expected to play.

    Its really easy to blame but it takes really hard to come up with solution. If the author of the above post has some plan of action he/she could share in thsi forum. Again assigning dots is individual choice IN admin never assign points good anology would be when you speak to group of people some people like it some may diagree so why to blame IV..

    i seriously doubt if the folks out there in uscis analyse the way we do here in these forums. think for a minute... if they work so sincerely and intelligently, they wouldnt be working for 20$/hr. wish there were performance based payment schemes for these folks.
    ofcourse if there is a software designed by us, its a different story ;)

    Like I said, I did not catch the whole speech, but from what I heard, he was not talking completely against it, he mentioned that businesses need more H1B's and should be able to hire foreign talent.

    He was mainly against abuse by big consulting firms (he gave out a statistic that 20K of the H1B went for 8 or 9 of the top consulting firms or something like that).

    At least there is something happening..... we have only two weeks....... this may be our only chance this year to attach anything EB
    Please follow all the different threads/news on this forum about Durbin and Grassley bills. There is nothing good there for H1B or EB visa provisions. Nothing good comes out of that, neither for employees (prospective or current) nor for employers...my 2 cents...

    Couple of points I disagree,

    1. If we assume them as I485 apps, we also need to take Family numbers into account. So EB2 LCs can only be around 23000.
    2. In 2007, Perm wasn't as hopeless as it is now. So people were getting LCs in less than 3 months.

    So adding all these, here is my break up

    Year LC# EB2 LC Visa #
    2004 12000 5000 11250
    2005 7000 2000 4500
    2006 18000 8000 18000
    2007-Pre 10000 8000 18000
    2007-Post 15000 9000 20250
    2008 1500 1000 2250

    With this, if EB2 I is as lucky as last year. We should see PD of 2006 when we goto next year.

    Again it is just a guess..

    I could not help but to post all my research. i myself recovered money successfully from ex employer.now i am 100% confident that i can handle all claims(only when i am right and have proper documentation) without a lawyer.never file a case in first step.this is how one can go.....
    1) complain to State DOL (not federal dol) with the one page filled form and required documents.i faxed the form at 9pm in the night and next morning at 8:30 am i got a call from the investigator to verify my complaint.i said yes.by afternoon he called the employer and asked abt the complaint.at that time my state had only 2 investigators for whole state but see the quick response.i asked investigator how he is going to proceed.he said over 80% are solved on phone.this is how they do it.the investigator calls employer and says i received complaint like this and do u accept or not.if u do not accept we have to come to ur office and look at all the records.if we find more violations we will issue 100$(my state had this fee) for each violation.if u accept u have to pay 100$ for this violation....take a guess what the employer says....by next day afternoon investigation was done.then state dol sends violation notice to employer and employer pays that.after 1 week i got complete documents of the investigation and a letter saying this will help in ur civil case to recover money.
    2) i waited for some time to give my employer time if he is going to give my money.but i did not get.next thing i did is went to federal dol Wage and hour(W&H) office which was near to my home.u have to remember federal dol w&H works different from state dol.state dol investigates and imposes fine etc and sends all the resulting documents to u.federal dol w&h takes the complaint and works to settle the wages between u and employer.for my case employer was willing to pay 5 times less than what i was supposed to get.dol w&h called me and said r u willing to settle for this amount.i said no and i will go to court.again i got the documents after 2 or 3 days.
    3) here u have option to go to court to file a civil case or complain to ICE.ICE is little serious thing and i thought i will do that if i run out all my options.
    4) filing a civil case in small claims court is very easy if u follow right steps.u have to know company exact info as per secretary of state filing. search secretary of state "ur state" in google and u will get ur state secretary of state web site. search the company name and find ur exact company name,agent name and address.
    also,u have to file in the same county where ur employer is in or if ur employer is out of state u might file where u r working(some like that).i would ask the clerk whether i can file this case here.if its wrong county,ur case disposition will be rejected.u will waste fees and u have to file again in right county.even though i found all the info and asked the clerk 5 times,she told me the wrong info.ofcourse i recovered that money too.each state has limit on small claims court.mine was like 7000$ and 7500$ was the limit. as per the law if u did not get ur salary within 48hrs or the next pay date of the company u r entitled to get 3 times what u r owed.u need to write a letter saying why u r filing and how much u want.this letter is very important and write what documents proof u have.i wrote dol investigation was already done and i have all the documents proof and hence i am claiming 21,000$ as per the law.since small claims court has 7500$ limited, judge will give u 7500$ when u win the case.after filing the case employer will have 30 days and mine was settled out of court for the full amount he owed including the court costs.if the amount is more than small claims court amount u can file in appeals court.u can defend ur self and no need of attorney as DOL already completed investigation successfully in favor of u.there is no way employer can deny the dol investigation results.
    5) if going to court is too intimidating go for ICE and ice does all the work for u.but ICE is a very serious organization and u know the rest.....
    do not communicate with the employer by phone or by in person.if u want, communicate thru e-mail as there will be proof and be very courteous,professional as if u r the victim.keep all the e-mails and replies if at all u go to court and show the judge.judges always gives benefit of doubt to employee in these cases and to tenants in landlord-tenant cases regarding lease,deposits etc.
    the negative thing abt going to court in the first step is u do not have proof that ur employer did not give checks.usually employers run the pay roll regularly but they do not give u the checks.they save all those checks with the right date when u were supposed to get but they do not give.when u go to the court in first step what they do is show copies of those checks and tell the judge i gave the checks on time and u did not deposit.the burden is on the employee to deposit the checks on right time.so,basically u r screwed at that time.all these employers know that.that is why u have to be calm and diligent so that u do not do this silly mistake.
    this is how i went and i read a lot on the internet before doing.hope this helps.please do research and act accordingly as each case may differ...
    I am not an attorney...i am just an immigrant stuck in GC Q like u guys....

    AFAIK, once you work on EAD, you can not be back on H1B. Please check this with your lawyer.

    However what I do not know, and what my lawyer also could not answer till this point is, if after travelling abroad using AP, can one transfer same H1 to a new employer? I know it is possible to continue working on H1 with the same employer. But what if one need H1 transfer?

    Suppose you work for Company A on H-1B. You get out of the U.S. and come back with AP. You become parolee at that time. File an H-1B extension with Employer A, get new I-94 that indicates your status is now H-1B.

    6 months later, you get another job with Employer B. Since you already are on H-1B with Company A, you should be able to transfer your H-1B to Company B.

    Can I add my spouse before or After marriage?I am planning to get married in 4 to 5 months.My attorney told me that he will be ready to file I-485 in July and my current H1-B is valid till Dec 2007,so if I go back to country for marriage and coming back on AP,so I think so I will be ok,but should my wife able to get H-4 visa stamp on her passport and once she came back in USA on H-4 should I will be able to add her right away in I-485 when PD dates will be current or should I have to wait 60 days then apply her for I-485.

    As per the current 'rules' EB1, EB2, EB3 are given EQUAL preference .... countrywise

    My guess is that EB3 has more people in line - for the same reason that there are more people with Bachelors than those with PhDs.

    If only USCIS/DHS give an accurate(!) number of apps in each category ... then we can make some informed decision instead of hoping for something like Jul 07.

    Depending on what line we are in - we want that to move not slower (than others). And one of the fundamental concepts in queueing theory is that " as the system gets congested, servicing delay increases"

    Like i read in friedman's book ... paraphrased - "If someone lost a job - the um-employment rate is not 5% or 10% - it is 100%"

    You seem to believe in all the conspiracy theories out there. India is no more a third world country. There are many deep pockets and if there was any such arbitrague existing people will mint money all day long. Rupee is not fully floating currency that doesn't mean you can control what the exchange rate is going to be. No company or congolmerate can manipulate market like that.

    Yes, we are not a third world country. Thats why we still see people like Harshad Mehta and Abdul karim Telgi. Both stock market and stamp paper, backbone of indian economy could be easily exploited by two individuals.

    We are still manipulating the stock market. From 3000 to 21,000. Every sadhus, saint, soothsayers, magician, poojari's, astrologers predicting sensex to touch 35,000 by this year end. Even one guy predicted, 50,000 points in 2010.

    I am just telling the fact. Look at TOI and other online newpapers economic section. Read the past year news.

    Side note: stable oil(price) is the backbone of world economy. We know who manipulates this oil market and who gains out of it? Is it not a few corporations? But tell me honestly how many countries are affected by this inflated oil price.

    One wallstreet analyst said. If you have Iran and Isreal in one statement, that is more than enough to shoot up the oil price. Why do we see calm and storm in the market every now and then?

    Point here is: if this can happen in the developed nations, why not in India?

    This case should not be very complicated. It is an "accident", you had insurance, you had all other legal documents to operate a vehicle. Why don't you consult a lawyer and ask to counter-sue for 5 million dollars - for emotional distress. An accident is an accident. It was on a public road and you were within speed limit. If someone does not want to get hurt they should sit at home their whole life and pray that the roof does not drop on them.

    If you are sure you did not break any laws like DUI - just ask the attorney is you can counter sue.....may be they will drop the $3 million suit

    Ok, so here are some more thoughts ... obviously we are all stuck in our current positions and we are worried about the future. Unless, we do something to be prepared we won't be better off when we get our GC's? Given where most of us are I think we have two options:
    1. Advance your education (MBA/PM/certifications etc.)
    2. Start a business.

    I would like to hear from everyone who has or wants to start a business.
    1. Have you thought of starting a business?
    2. What does it take to start a business while on H1B
    3. Is it worth the effort not knowing if/when you will get the green card. Remember starting a business is not a short-term goal.
    4. Are there businesses that cross borders i.e. we can continue to run the business even if we have to leave the US?
