Well, i saw it ended tonight so i crapped this out in 20 seconds. I don't think i'm gonna win, but i had fun i guess. First battle i've tried on Kirupa. Toyed around with colors a bit, enjoy!

Anybody has this situation?
My case was sent by my attorney June 29th (current July bulletin) USPS certified mail.
As per USPS online tracking record it was delivered July 2nd 12.45 PM.
No receipt yet. So far sounds okay.
But I got the copy of actual delivery receipt stamped by F.Heinauer (Director NSC USCIS) with the date 062907.
It is a stamp so some of their employee clearly has stamped it.
Now I am confused if that’s the receipt date they are going to go with and may reject the application.
And with this many application it may take more than AUG 17th to receive anything back.
I am very sure it was reached on July 2nd. It was only sent June 29th afternoon.
And USPS is telling there is no delivery can reach so fast. According to USPS the guy who might have stamped the delivery did not changed the stamp date from 0629 to 0702 since it was a weekend.
Anybody in the same situation? Any advice?

I don't mean to embarass you or make you feel awkward by thanking you every time you post, but the excruciating detail that you get into, in your posts, to back your statements never ceases to amaze me, and I know I speak for a lot of people here.
That being said, if I may bother you with one more question.
Lets assume that the 140 is revoked right after the employee leaves, and the employer had 100% abilitiy to pay the employee until that moment.
6 months after the employee left, and after the 140 was revoked, the employer gets an ability to pay RFE on some other pending or unrevoked 140 of theirs. In that case ,can the 140 that was revoked 5 months ago be in danger?
Of course, this is assuming that all AC21 memos till date are considered binding, and no memo changes to AC21 have happened.

It's not a wise decision to invest in India for another few years. If a controlled market like the US experiences such short comings, you cant even imagine how things will get in India. It's going to be extremely volatile and the armageddon is just about to begin. Stay away from there.

I remember the interim rule saying that:
- the process of labor substitution itself will be eliminated
- I-140 applications based on approved LCs (now, only in your name only) need to be applied within 45-days of LC's approval.
Does someone have the (official) link to this news that DOL has submitted this rule to OMB.
No, 45 days condition is not for "to file 140 within 45 days of labor approval"
But it is for the company to substitute the LC for some other employee within 45 days.
There is no time limit set to file I-140 for the employee for whom the LC was issued.

I think that is what they will do in order not to look like fools.
the question is, What happens to those july filers whose applications have not been returned yet and who will become current in the next bulletin.
Will USCIS ask them for the new fees.... Will they have to do all paperwork again including medicals.....what a mess!
The thing is I am sure most people here will not have a problem with paying the new higher fees. Infact it might turn out to be cheaper in the long run, cause as I understand it the new fee structure has the EAD and AP fees built in for a one time payment instead of yearly renewals. Like I said this is my understanding.
If this is the case we will be better off with new fees, cause even if they do decide to accept the 485's there is no way the approvals are coming anytime in the near future. I am sure if they do accept the 485's the dates will retrogress to the stone ages. So we can avail free renewals of EAD's and AP's till then.
But when i think about this again, If they do decide to go charge the new fees for all applications in July then wouldn't it put them in a worse situation, as it would become all too obvious that all this flip - flop was just so that could earn more money.

I voted for both questions.
BTW Sen. McCain is now front runner in GOP for presidential candidate. Even though he backed out of immigration reform, I consider him our friend and also a person of integrity. I am glad to see him emerge as front runner. On the other hand Tom Tancredo figured nowhere, even when immigration was still hot issue. That should be enough for our friends in NumbersUSA & ALIPAC to see where they stand in terms of public support for their issues.

@krishmunn thanks for your analysis too , i had sent him a bunch of emails about 10 of them and he never responded to them, when i called him about why is he not replying to my emails he said i cannot have any email conversation with you, it did not strike me then why ? but after talking to all the guys here i understand why he said so, i do not know if this would be enough . but i am just preparing my packet to send to DOL
@PrinceVA i really appreciate your help and your kindness at least someone in the fraternity doesn't believe in finding the nationality before helping. Well i really appreciate your concern and i wish that you were a part of my employers team, but i have my tickets booked and bags packed . I would now empower people from all over the world to come a little more prepared on H1B to US. I admit to being dumb before landing here but i have gotten my much important experience which i will pass on through fake busting.

We have to understand that there is a myriad of laws; INA, CFR's; USCIS policy binding memos; internal memos; appeals decisions, court cases, precedent aao decisions, precedent legal cases.
Now; the ac21 memo is a memo that uscis officers have to follow. However; the memo is not in accordanc with INA 245 or AC21.
INA 245 states that a valid and approved 140 is needed for a person to get lawful permanent residency.
ac21 says that a person can change jobs after 485 has been pending for more then 180 days.
The above two things are the law.
In ac21 law; it doesn't say anything about the scenario if 140 is revoked by employer. It is totally silent to it.

I just called everyone on the list.
The one thing I felt once my part was done was my sense of accomplishment - I helped - in the smallest way possible. Trust me - while I consider myself blessed when I read some of our members' story - I still feel like my battle to reaching this point is very poignant.
Call - feel good on a Monday (which usually is SUCH the worst day ever of the week for me:).

This is not a waste of time. CNN really cares about rating and I am pretty sure for many people like you and me, CNN is the first stop for news. If they realize that we are a force to reckon with, they will think twice before airing such shows. By signing nobody is expecting, CNN firing Lou Dobb's but at least CNN will be careful airing these baseless facts..That's all we need..attention and fairness..espeacilly when they claim they are the most trusted name in the news..

You know my old H1B case was reopened on Sept. 28, and the USCIS Emailed me that they sent a notice. But I haven't received such notice, my employer/attorney also didn't receive any notice. I wonder the USCIS didn't send this notice at all!
The best way to find out the reason for reopening is to call USCIS. But since this is a I129 petition only the employer or the attorney can get any information since USCIS will not disclose any such information to the beneficiary. If the previous employer agrees to call USCIS, things will be clear.
